These Terms and Conditions ("Terms") govern your use of the Staraxy mobile application ("App") and any related services provided by Staraxy Technology G.K. ("Staraxy," "we," "us," or "our"). By using the App, you agree to be bound by these Terms, so please read them carefully.
1. Acceptance of Terms
By downloading and using the Staraxy App, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the App.
2. Description of Services
The Staraxy App is designed to provide users with access to meditation and mindfulness content to help improve mental and physical wellness. These services may include guided meditations, relaxation exercises, creative exercises, and related resources.
3. User Eligibility
To use the Staraxy App, you must be at least 18 years of age or have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet this eligibility requirement.
4. Privacy
Your use of the Staraxy App is subject to our Privacy Policy, which can be found at https://staraxy.com/privacy. Please review the Privacy Policy to understand how we collect, use, and share your personal information.
5. User Accounts
a. You are required to create a user account to access certain features of the App. When creating an account, you agree to provide accurate and complete information.
b. You are responsible for maintaining the confidentiality of your account login credentials, and you are solely responsible for all activities that occur under your account.
c. You must promptly notify us of any unauthorized use or security breach of your account.
6. License and Restrictions
a. Subject to these Terms, Staraxy grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
b. You may not:
Reverse engineer, decompile, or disassemble the App.
Modify, reproduce, distribute, or create derivative works based on the App.
Use the App for any illegal or unauthorized purpose.
Interfere with or disrupt the App or its servers.
7. Content and Ownership
a. The content provided through the App, including text, images, audio, and other media, is owned by Staraxy or its content providers and is protected by copyright and other intellectual property laws.
b. You may not reproduce, distribute, or use this content without prior written consent from Staraxy.
8. Updates and Changes
Staraxy may update, modify, or change the App or these Terms at any time. You will be notified of material changes to these Terms, and your continued use of the App will constitute your acceptance of the revised Terms.
9. Termination
a. By the User
a.1. You might cancel your subscription at any time with effect from the end of your current subscription through the Apple App Store or our iPhone application, You can cancel your subscription by disabling auto-renewal of paid in-app subscriptions. To do this, You must select "Manage App Subscriptions" under Settings in your App Store Account and then select the subscription You wish to change.
a.2. If You do not cancel your subscription before the end of your current subscription period, the subscription will continue for a further period.
b. By Staraxy
b.1. Staraxy reserves the right to terminate or suspend your access to the App at our discretion, with or without cause. Good cause entitling us to terminate your use of the Services for cause exists, in particular, if:
- You copy or download the audio or video content of the services without permission,
- Your use of the services may constitute a violation of any applicable laws or regulations.
- Your use of the services under the legal age in your jurisdiction .
10. Disclaimers
a. The App and its content are provided "as is" without warranties of any kind. Staraxy does not provide medical advice, and the App should not be used as a substitute for professional healthcare or counseling.
b. The App is not intended to be used for the diagnosis or treatment of mental health-related conditions. It should not be considered a substitution for proper medical treatment or consultation with a qualified mental health professional. If you have or suspect you may have a mental health condition, we strongly recommend that you consult with a licensed mental health professional or healthcare provider for appropriate guidance and treatment. Your health and well-being are of paramount importance, and the App is not a replacement for professional medical care.
11. Availability
Staraxy does not guarantee the availability of the App at any time or the occurrence and/or proper technical transmission of the offered services. Staraxy endeavors to make the Website and the App available for use by the User as uninterruptedly as possible. Nonetheless, downtimes may occur due to maintenance work and technical problems. The User is not entitled to any claims due to possible downtimes. Staraxy does not guarantee that all services or parts thereof can be used from any location. Staraxy is entitled without prior notice to change or adapt the App, e.g. due to legal requirements or technical developments. Staraxy reserves the right to delete the App in parts or as a whole as well as to discontinue the offer temporarily or permanently.
12. Limitation of Liability
Staraxy will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or any content therein.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes related to these Terms will be resolved in the appropriate court within Japan.
